1. Legal Status and Introduction
Welcome to www.kale.foundation (the “Site”).
The KALE Foundation is a philanthropic initiative operated by KALE Capital Limited, a company incorporated in Hong Kong. It is not a separate legal entity.
Unless expressly stated otherwise, references in these Terms to “The KALE Foundation”, “we”, “us” or “our” mean KALE Capital Limited acting through its The KALE Foundation initiative.
The KALE Foundation is not a separately incorporated charity, foundation, trust, or company limited by guarantee. Nothing on this Site shall be construed as representing that The KALE Foundation is a registered charity under Section 88 of the Inland Revenue Ordinance (Cap. 112, Laws of Hong Kong).
By accessing or using this Site, you agree to be bound by these Terms of Use. If you do not accept them, you should discontinue use of the Site.
We reserve the right to amend these Terms from time to time. Any revisions will take effect upon posting.
2. Nature and Purpose of the Site
This Site is provided for general informational purposes only.
The Site describes philanthropic activities and initiatives undertaken by KALE Capital Limited under the name “The KALE Foundation”. It does not constitute:
An offer to solicit donations from the public;
An invitation to invest;
Professional, legal, tax, or financial advice;
A representation of charitable registration or independent non-profit status.
We may, at our sole discretion and without notice:
Modify or update the Site or any part of it;
Suspend or discontinue the Site;
Restrict access to certain sections.
3. No Solicitation and No Public Fundraising
Unless expressly stated otherwise:
We do not solicit donations from the public through this Site.
No representation is made that any contribution is tax-deductible.
Nothing on this Site constitutes a public fundraising appeal within the meaning of applicable Hong Kong law.
Any philanthropic activities described are funded privately or through internal arrangements determined by KALE Capital Limited.
4. Intellectual Property
All content on the Site (“Content”), including text, graphics, logos, images, photographs, documents and other materials, is protected by copyright and other intellectual property rights.
You may not, without our prior written consent:
Reproduce, distribute, modify, publish, or publicly display any Content for commercial or public purposes;

Create derivative works from the Content;
Reverse engineer any downloadable material;
Infringe any intellectual property rights connected with the Site.
No intellectual property rights are transferred to you by virtue of your use of the Site.

11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Hong Kong.
You irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong.

If any provision of these Terms is held to be unenforceable, the remainder shall remain in full force and effect.
The English version shall prevail over any Chinese version provided for reference.
